"The Auditor erred in not finding the fact from the testimony that the accountant was quilty of supreme negligence by not sending his ward to the School for Soldiers Orphans provided by the state, which was located part of the time at the home of the ward in the Village of Paradise, and subsequently in the Borough of Mount Joy in Lancaster County and in allowing the accountant fee the alleged expenditures for maintenance and clothing. the auditor erred in not charging the costs of audit to the accountant. Signed, H. Brubaker, att
for Margaret E. Clark, the ward

Also noted in this document was the point of sending her to Soldiers Orphans school. Of that point the Guardian states " I made an endeavour to send them to the Soldiers Orphans school. I asked the Mother to help send them. I asked Dr Martin to talk to them about it. I told the Mother that they ought to go. She said yes. The School moved to Mount Joy from Paradise in a short time. The reason I did not take them to Mount Joy is because I would not tie and haul them there. I thought I did everything I coud do, to get them, except, to tie them and haul them there." That testimony has not been contradicted at all, as we have been able to discover. on 13 August 1881.8 She witnessed that an audit was done on William Hamilton's guardianship records and it was found that monies owed to Margaret were never paid to her.
'To the extent herein stated, we sustain exeption '9' and no further. In accordance with the rate applied by the auditor, we will add interest on said sums up to Sept 22, 1880, the day of filing first exceptions to wit;

1st: the Guardian must be allowed one years time after receiving the money to reinvest it; except the two last years when interest must be charged after the accumulation of six months interest.
2nd; The Accountant must have credit for the portion of money and orders delivered to the mother for the child during the two and one half years after the accountant became guardian and during which time this ward, Margaret, was residing with the Mother. The Mother was married to Wm Murray Feby 15, 1866 and from Feby 16th, 1866 the pension was drawn by the Guardian for the choldren and from that time on the ward remained at home about two and one half years. From Feby 16, 1866 to Aug 16 1869 Margaret will be charged with her prtion of all moneys and orders received in addition to the items charged by your auditor in his re-statement of the guardians account except where it would be a duplication of them.
3rd; The Guardian must have credit for the item of thirty($30.00) dollars of date of Jun 21, 1874 which he says he gve to Margaret in the presence of her mother.
4th; The item of twenty-one dollars and 5 cents will be allowed as Margaret's share of the expense of collection the pension. After the settlement with Mr Black as appears by paper marked DPRJ No. 2, the guardian continued to pay Mr Black $3.00 every half year for collecting the pension.
